
Security boss Calvin Mathibeli has suffered yet another legal setback after his attempt
to overturn a previous court ruling was dismissed with punitive costs.
The latest development stems from a case brought last month by KwaZulu-Natal
Police Commissioner Lt-Gen Nhlanhla Mkhwanazi, who approached the KZN High
Court following allegations made by Mathibeli. In his statements, Mathibeli accused
Mkhwanazi of being corrupt, captured, and implied his involvement in unlawful
killings.
The High Court initially ruled in favour of Mkhwanazi, finding the remarks to be
defamatory and ordering Mathibeli to issue a public retraction and refrain from
repeating the statements.
Mathibeli subsequently sought leave to appeal the judgment. However, that
application has now been dismissed, reinforcing the original ruling.
As a result, Mathibeli is legally obligated to comply with the court’s order within 24
hours. This includes publicly retracting the statements and ceasing any further
defamatory remarks against the provincial commissioner.
The inclusion of punitive costs signals the court’s strong disapproval of Mathibeli’s
conduct, marking a significant victory for Mkhwanazi in an increasingly high-profile
legal battle.
