President Cyril Ramaphosa’s urgent application to stop Parliament’s Section 89 impeachment proceedings will be heard in the Western Cape High Court on Wednesday and Thursday.
The President is seeking an order suspending the parliamentary process while his legal challenge against the Section 89 Independent Panel report is being reviewed.
The independent panel previously found that Ramaphosa has a prima facie case to answer regarding the Phala Phala matter, prompting calls for Parliament to consider impeachment proceedings under Section 89 of the Constitution.
Ramaphosa argues that allowing Parliament to continue with the process before the court has ruled on the legality of the panel’s findings could cause irreparable harm and prejudice his rights.The outcome of the urgent court application could have significant implications for the impeachment process and Parliament’s next steps.
The Phala Phala matter has remained one of the most politically contentious issues facing the President since it first emerged.
