Julius Malema has been granted leave to appeal his five-year prison sentence, allowing him to remain free while the legal process unfolds. The decision was handed down on April 16, 2026, by the KuGompo City Magistrate’s Court, shortly after sentencing him for unlawful possession of a firearm linked to a 2018 incident.
The court’s ruling means Malema will not begin serving his sentence immediately. Instead, he will challenge the conviction and sentence in a higher court. An appeal involves arguing that the original magistrate made errors in interpreting the law or assessing the facts of the case.
Legal experts note that appeal processes in South Africa can be lengthy, sometimes taking years to conclude. During this period, Malema will remain out of prison unless a higher court overturns the decision to grant leave to appeal.
The case has drawn significant public and political attention, given Malema’s prominent role in national politics. Supporters argue the appeal will provide an opportunity for a fair reassessment, while critics say justice is being delayed.
Further proceedings are expected in the coming months as the appeal process begins.
