The legal dispute involving Pitso Mosimane, his management company MT Sports and Mamelodi Sundowns is now before the Supreme Court of Appeal (SCA) in Bloemfontein.
This follows a ruling by Judge Shanaaz Mia, who ordered Mosimane, his agent Moira Tlhagale and MT Sports to repay R7.9 million received as a commission for negotiating the coach’s contract in 2020.At the centre of the dispute is a “clawback clause” in Mosimane’s contract, which required him to return the commission if he terminated the agreement before its expiry.
Mosimane left Sundowns after just four months to join Egyptian giants Al Ahly.MT Sports’ lawyer, Erick Mabuza of Mabuza Attorneys, confirmed that the matter will now be heard at the SCA, citing several serious concerns about how the contract was executed.
Meanwhile, Mosimane is also embroiled in a separate dispute with Sundowns-linked matters, after Iranian agent Hamed Ghadiri accused him of embezzling R1.2 million related to a deal with Esteghlal FC in October last year.Ghadiri claims he was granted special power of attorney by MT Sports to facilitate the move and agreed on a fee, but alleges Mosimane has avoided payment, saying he is still awaiting funds owed by Esteghlal after leaving the club with a year remaining on his contract. The matter was taken to the FIFA Football Tribunal, and Ghadiri insists Mosimane has already been paid.
While legal action has been threatened, Mosimane has indicated that both parties’ lawyers are still in negotiations.Currently without a club, Mosimane has not taken up a new coaching role since leaving Iran. The highly decorated coach—who won 11 trophies with Sundowns, as well as the CAF Champions League and a bronze medal at the FIFA Club World Cup with Al Ahly—is now focusing on a children’s school project in Johannesburg.
