COURT VICTORY FOR MALEMA IN DEFAMATION BATTLE AGAINST KHAWULA

The Gauteng High Court has ruled in favour of Julius Malema in a high-profile defamation case against social media commentator Musa Khawula, marking a significant legal victory for the Economic Freedom Fighters (EFF) leader.

In its judgment delivered on Tuesday, the court found that Khawula had published defamatory, false and unlawful statements concerning Malema and his wife, Mantwa Matlala. The claims, which questioned aspects of their marital status, were deemed to have no factual basis and to have caused reputational harm.

The court further ordered Khawula to pay all legal costs associated with the case, reinforcing the seriousness with which the judiciary treats the spread of unverified allegations, particularly on social media platforms.Legal analysts say the ruling underscores the growing willingness of South African courts to hold individuals accountable for online defamation, especially where public figures are targeted without evidence.

The judgment also highlights the balance courts seek to maintain between freedom of expression and the protection of personal dignity.Malema, a prominent and often controversial political figure, has previously warned against what he describes as coordinated misinformation campaigns aimed at discrediting him and his family.

The outcome is expected to set a precedent for similar cases involving digital defamation in South Africa.
